Know Jimmo New CMS Implementation Activity 1

The Center for Medicare Advocacy (CMA) released a new blog, "Know Jimmo | New CMS Implementation Activity! CMS Joins the CMA to Advance Access to Medicare-Covered Skilled Care to Maintain One’s Condition or Slow Decline."

Jimmo v. Sebelius is a class action lawsuit brought by the Center for Medicare Advocacy and Vermont Legal Aid on behalf of beneficiaries who were denied Medicare coverage for skilled care because they were not improving.

In 2013, the federal district court approved a settlement agreement with the Centers for Medicare & Medicaid Services (CMS), concluding that Medicare covers skilled care to maintain an individual's condition or slow decline.

In December 2023, the CMA met with CMS, seeking to jointly implement the Jimmo rulings and advance beneficiaries' access to medicare coverage. CMS has issued several reminders to providers and adjudicators to refresh and train staff and contractors with links to their Jimmo settlement page.

The CMA has also published a blog, "When Should Medicare Coverage Be Available For Skilled Nursing Facility (SNF) Care?," outlining specific criteria that should be met to be covered by Medicare.
